GILBERT, AZ (3TV/CBS 5)– A New Mexico man is accused of traveling to Arizona to have sex with a 13-year-old Gilbert girl after the two talked on Xbox Live.
According to the Gilbert Police Department, the mother of the girl contacted police after she discovered Sammy Garcia, 19, visited Arizona to engage in sexual intercourse with her daughter.
The incident occurred on Nov 1. at a Best Western Hotel near the area of Warner and Power roads.
The call from the victim’s mother prompted police to serve a search warrant at the hotel room.
Police found the room was registered to Garcia.
When police interviewed the victim, she admitted to having sex with Garcia on several occasions including at the hotel room and in her bedroom.
The victim told officers that she met Garcia online while using Xbox Live.
Garcia told officers that he was aware of the victim’s age before they met in person.
According to court documents, Garcia admitted to officers to sneaking to the girl’s home to engage in sexual acts between the dates of Oct. 22 to Oct. 26 and then from Oct. 29 to Oct. 31.
Garcia also told officers that while he understood his actions were criminal, he did not believe his actions were morally wrong.
Garcia was charged with a count of sexual conduct with a minor and a count of contribute to juvenile delinquency.
